Cookie Policy
Last Updated: September 2026
This Cookie Policy explains how Otwayite ("Otwayite," "we," "us," or "our") uses cookies, pixels, web beacons, clear GIFs, local storage objects, mobile advertising identifiers, software development kits, and other similar tracking technologies (collectively, "Cookies") on otwayite.net, accessible at otwayite.net, and in connection with our software-as-a-service platform, applications, and related services (collectively, the "Services").
Otwayite is organized under the laws of the United States, and this Cookie Policy is drafted to address United States federal and state requirements, including the California Consumer Privacy Act as amended by the California Privacy Rights Act ("CCPA/CPRA") and other state privacy laws where applicable. This Cookie Policy should be read together with our Privacy Policy available at privacy.php, our Terms and Conditions available at terms-conditions.php, and our Terms of Service available at terms_of_service.php, each of which is incorporated into this Cookie Policy by reference. In the event of a conflict regarding the handling of personal information, our Privacy Policy controls.
By accessing, browsing, or otherwise using the Services, you acknowledge that you have read, understood, and agreed to the practices described in this Cookie Policy. If you do not agree with the use of Cookies as described here, you should adjust your browser settings to block or delete Cookies or refrain from using the Services. Please note that disabling certain Cookies may prevent portions of the Services from functioning properly.
1. What Are Cookies
Cookies are small text files containing a string of alphanumeric characters that are placed on your computer, tablet, smartphone, or other device when you visit a website or interact with an online service. Cookies allow a website to recognize your device, remember your preferences, and distinguish you from other visitors. Cookies generally do not contain information that directly identifies you by name, but they may be linked to personal information that we or third parties hold about you, and where that linkage occurs, the combined data is treated as personal information under applicable law.
Cookies are commonly categorized by lifespan and by origin. "Session Cookies" exist only for the duration of your browsing session and are automatically deleted when you close your browser. "Persistent Cookies" remain on your device for a set period or until you delete them. "First-party Cookies" are set directly by otwayite.net and are readable only by us, while "third-party Cookies" are set by a Otwayite other than otwayite.net and are used by our service providers, analytics vendors, advertising partners, and other third parties.
We also use technologies that function similarly to Cookies, including web beacons and pixels (tiny graphic images embedded in pages or emails that report whether content was viewed), local storage and session storage (which store data locally in your browser), and mobile software development kits (which allow data collection within mobile applications). References to "Cookies" in this policy include these related technologies, and the controls described in this policy apply to them to the extent technically feasible.
2. Types of Cookies We Use
We use Cookies for the categories of purposes described in Sections 3 through 6 below: Strictly Necessary (Essential) Cookies, Analytics and Performance Cookies, Marketing and Advertising Cookies, and Functionality and Preference Cookies. Not every category is used on every page or in every part of the Services, and the specific Cookies deployed may change over time as we update the Services, change service providers, or respond to legal requirements. A current list of the Cookies in use, including their purpose, provider, and retention period, may be requested from us using the contact details in Section 10.
The duration for which Cookies remain on your device varies. Essential session Cookies typically expire when your session ends or within a short period thereafter. Analytics and marketing Cookies may persist for days, months, or longer, depending on the provider and configuration. Where we retain Cookie-derived data linked to an identifiable individual, we retain it only for as long as necessary for the purposes described in this policy and our Privacy Policy, and in accordance with applicable law.
Because our primary market is the United States, we generally operate on an opt-out model consistent with the CCPA/CPRA rather than a European-style prior-consent banner model. This means that certain Cookies, particularly those that are strictly necessary and those used for analytics or cross-context behavioral advertising, may be set when you visit the Services, and you have the right to opt out of the sale or sharing of your personal information as described in Section 7. Where we determine that the law of a particular jurisdiction requires prior consent, or where a visitor enables a legally recognized opt-out preference signal, we will honor that requirement or signal as applicable.
3. Essential Cookies
Essential Cookies, also referred to as strictly necessary Cookies, are required for the Services to operate and to provide you with features you have requested. They enable core functionality such as authenticating you when you log in, maintaining your session as you move between pages, securing your account, processing payments, preventing fraudulent or abusive activity, balancing network load, and remembering your Cookie preference selections. Without these Cookies, the Services cannot function reliably, and disabling them may render the Services, or portions of them, unavailable.
Essential Cookies do not typically collect information about you for marketing purposes, and we do not treat their use as a "sale" or "share" of personal information under the CCPA/CPRA because they are used solely to provide the Services you have requested and to protect the security and integrity of those Services. Because of their necessity, Essential Cookies may be set before or independently of any opt-out election you make, and they generally cannot be disabled through our Cookie preference controls.
Examples of Essential Cookie functions include: maintaining authenticated sessions and single sign-on state; remembering items placed in a cart or an in-progress workflow; enforcing security controls, rate limits, and protection against cross-site request forgery; storing your consent and opt-out preferences so that we do not repeatedly ask for them; and supporting critical infrastructure such as load balancers and content delivery networks. If you block these Cookies through your browser, you do so at your own risk and may experience degraded or non-functional Service performance.
4. Analytics Cookies
Analytics Cookies help us understand how visitors and customers interact with the Services. They collect information such as pages viewed, features used, time spent, referring sources, navigation paths, error and performance data, device type, browser type, and approximate geographic region. We use this information in aggregated and statistical form to measure the effectiveness of our content and features, diagnose technical problems, improve usability, and plan product development.
Analytics data is generally used on an aggregate or de-identified basis, and we take reasonable measures to limit the collection, retention, and combination of such data with information that identifies you. Where our analytics providers process data in a manner that constitutes a "sale" or "sharing" for cross-context behavioral advertising under the CCPA/CPRA, we will treat that activity as subject to your right to opt out, and we honor legally recognized opt-out preference signals, including the Global Privacy Control, where required by applicable law. Options to limit or disable analytics Cookies are described in Sections 7 and 8.
Some analytics Cookies are persistent and may remain on your device beyond the current session so that we can compare usage over time and identify trends. We configure our analytics tools, where available, to use IP address masking or truncation, data retention limits, and restricted data-sharing settings. However, no analytics system is completely accurate, and analytics outputs should be understood as estimates rather than precise records of individual behavior. If you opt out of analytics Cookies, we will continue to collect a limited amount of aggregated or server-side measurement data necessary to operate and secure the Services.
5. Marketing Cookies
Marketing and advertising Cookies, along with related pixels and identifiers, are used to deliver advertising that is more relevant to your interests, to measure the performance of our advertising campaigns, to limit how often you see a particular advertisement, and to understand whether you took an action, such as signing up for a trial after viewing an advertisement. These Cookies may be set by us or by third-party advertising networks, demand-side platforms, social media platforms, and measurement partners, and they may be used to build audience segments or to serve advertising to you across different websites and applications.
Under the CCPA/CPRA, certain uses of Cookies for cross-context behavioral advertising may constitute a "sale" or "share" of personal information, even where no money changes hands. Accordingly, you have the right to opt out of the sale or sharing of your personal information by using the opt-out mechanisms described in Section 7, including our Cookie preference controls, the Global Privacy Control signal, or a browser or extension that transmits a recognized opt-out preference signal. We will not discriminate against you for exercising these rights, and we will not require you to create an account in order to exercise an opt-out right that does not require authentication to fulfill.
Marketing Cookies may also be used in connection with platform-based advertising tools that match business contact information for business-to-business marketing purposes. Where such activity involves personal information subject to applicable state privacy laws, we require our vendors to honor opt-out requests and contractual restrictions, and we limit use of the information to the permitted purposes. Please note that opting out of marketing Cookies does not mean you will stop seeing advertising; it means the advertising you see may be less personalized and may be based on generalized, non-behavioral factors such as your general location or the content of the page you are viewing.
6. Third-Party Cookies
Some Cookies on the Services are placed and controlled by third parties rather than by us. These third parties may include analytics providers, advertising and advertising-measurement partners, payment processors, customer support and communication platforms, security and fraud-prevention vendors, content delivery networks, and social media platforms that offer embedded features such as sharing buttons, video players, or chat widgets. These third parties may collect information about your activity across the Services and across other websites, applications, and devices over time.
We do not control the Cookies set by third parties, and we do not control the information practices, retention periods, or onward disclosures of those third parties. Third-party Cookies are governed by the privacy policies and terms of the entities that set them, not by this Cookie Policy. We encourage you to review the privacy policies of the relevant third parties and to use the controls those parties make available. Where a third party acts as our service provider under a written contract, we limit its use of personal information to the purposes for which we engaged it, consistent with applicable law.
Certain third-party tools may continue to place or read Cookies on your device even after you interact with our Cookie preference controls, if you access those tools directly, if you are logged into a third-party account, or if your browser settings permit such activity. To the maximum extent permitted by law, Otwayite disclaims liability for the independent data collection or processing practices of third parties, and any dispute regarding those practices must be resolved between you and the applicable third party.
7. How to Control Cookies
You can manage your Cookie preferences in several ways. First, where available, our Cookie preference center allows you to accept, reject, or limit the use of Analytics, Marketing, and Functionality Cookies, and to change your selections at any time. Second, you may exercise your right to opt out of the sale or sharing of your personal information under the CCPA/CPRA and, where applicable, under other state privacy laws such as those in Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other states with comprehensive privacy statutes. To submit an opt-out request, you may use the mechanisms made available on the Services or contact us using the details in Section 10.
Where required by applicable law, we honor legally recognized opt-out preference signals, including the Global Privacy Control ("GPC"). If your browser or browser extension transmits a GPC signal, we will treat that signal as a valid request to opt out of the sale and sharing of your personal information for the browser and device you are using, to the extent required by law. We do not currently respond to legacy "Do Not Track" ("DNT") signals, as there is no common industry or legal standard for interpreting them, but a GPC signal is treated as an opt-out request because it is a recognized, standardized control.
Exercising your opt-out rights will not prevent you from using the Services and will not result in discriminatory treatment, including denial of goods or services, different pricing, or a lower quality of service, except as permitted by applicable law. You may also authorize an agent to submit a request on your behalf, subject to our verification procedures, including proof of your written permission and verification of your identity where required. If you are a resident of a state that provides rights to know, access, correct, or delete personal information, you may submit those requests as described in our Privacy Policy, and this Cookie Policy does not limit those rights. Right to opt out of sale/share applies to the extent we engage in such activities.
8. Browser Settings
Most browsers allow you to control Cookies through their settings menus. Commonly available options include viewing and deleting existing Cookies, blocking all Cookies, blocking only third-party Cookies, blocking Cookies from specific sites, and configuring the browser to notify you before a Cookie is stored. Instructions vary by browser and version, and you should consult your browser's help documentation for current guidance on managing Cookies and site data, including the fact that browser controls typically apply to the specific browser and device on which they are set.
You may also limit interest-based advertising through industry opt-out tools and platform-level controls. These include the Digital Advertising Alliance's consumer choice tools, the Network Advertising Initiative's opt-out tools, and the advertising and privacy settings offered by operating system and device manufacturers (such as the "Allow Apps to Request to Track" setting on iOS and the advertising ID controls on Android). These tools apply to participating companies and may not cover all data collection, and using them does not remove all advertising from the Services or from other websites you visit.
Please be aware that blocking or deleting Cookies may have consequences. If you delete Cookies, you may be logged out of the Services, lose saved preferences, or need to reconfigure settings. If you block Cookies entirely, certain features such as authentication, personalization, and checkout may not work. Clearing Cookies may also remove an opt-out preference you previously recorded with us, in which case we will rely on the most recent recorded preference or a recognized opt-out signal. Otwayite is not responsible for the effectiveness, availability, or functionality of any browser or third-party opt-out tool.
9. Updates to Policy
We may update this Cookie Policy from time to time to reflect changes in our practices, the Cookies we use, the technologies available, or applicable law. When we make changes, we will revise the "Last Updated" date at the top of this page. Material changes may also be communicated through a notice on the Services, by email, or by another reasonable method where required by applicable law. The most current version of this Cookie Policy will always be posted at cookie_notice.php.
Your continued use of the Services after an updated Cookie Policy becomes effective constitutes your acknowledgment and acceptance of the revised policy to the extent permitted by applicable law. If you do not agree with an update, you should stop using the Services or take steps to disable Cookies as described in Sections 7 and 8. We may retain prior versions of this Cookie Policy for recordkeeping purposes and can provide a copy upon request.
Nothing in this Cookie Policy creates any obligation to provide individualized notice of changes except where required by applicable law, and our failure to enforce any provision of this policy on any occasion is not a waiver of our right to enforce it later. If any provision of this Cookie Policy is found to be invalid or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

11. Limitation of Liability and Governing Law
To the maximum extent permitted by applicable law, the Services and all Cookies, tracking technologies, and opt-out mechanisms described in this Cookie Policy are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that any Cookie control, opt-out signal, or preference setting will be error-free, uninterrupted, or effective in every browser, device, application, or third-party environment.
To the maximum extent permitted by applicable law, Otwayite and its officers, directors, employees, agents, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to Cookies, third-party tracking technologies, browser settings, or opt-out tools, even if advised of the possibility of such damages. Where liability cannot be excluded, our aggregate liability will not exceed the greater of the amounts you paid to us for the Services in the twelve (12) months preceding the claim or one hundred U.S. dollars (US $100).
This Cookie Policy is governed by the laws of the United States and the state in which Otwayite is organized, without regard to conflict-of-law principles, except where the law of your state of residence provides mandatory rights that cannot be waived. Any provision of this Cookie Policy that conflicts with mandatory applicable law will be deemed modified to the minimum extent necessary to comply with that law, and all other provisions will remain in effect. Nothing in this section limits any right you may have under the CCPA/CPRA or other applicable state privacy law.
